This Privacy Notice (“Privacy Notice”) applies to the processing of personal data in connection with the provision of the GK8 website at www.gk8.io (the “Site”), and all of the services and products that we offer, including from the Sites (the “Services”). The Site and our Services are made available by GK8 LLC and GDS Crypto Technologies Israel, Ltd. and their respective affiliates (collectively referred to as “GK8”, “us”, “we”, “our”).GK8 is the data controller responsible for your personal data.
3.1 When you visit this Site, our web servers collect the details of your operating system, browser version, domain name and IP address, and the details of the web site you linked from to the Site. 4.3 Personnel that work for our clients and suppliers. If you (or your organization) work with us or otherwise partner with us, we may collect and process your personal data in connection with such partnership. For instance, if we are providing services to a client, investor, or intermediary, we may collect personal data about the client’s representatives including but not limited to the representatives’ names, contact details, and any other information necessary to provide the Services. 4.4 Job applicants. Please note that GK8 may also receive information from third party recruitment agencies. For this purpose, we may transfer the information you provide outside your country to a GK8 entity in another country that does not have similar data protection legislation and may provide a lower level of protection for your information. However, it is possible that information transmitted to GK8 may be read or obtained by other parties. Messages sent over the Internet cannot be guaranteed to be completely secure or error free as they are subject to possible interception, corruption, delay, loss or possible alteration. GK8 is not responsible for them and will not be liable to you or anyone else for any damages or otherwise in connection with any messages sent by you to GK8 or any message sent by GK8 to you over the Internet. If you send email (encrypted or not) to GK8 over the Internet, you are accepting the associated risks, including lack of confidentiality.9.4 Further, despite all possible security measures that GK8 would take to keep this Site free from hacking and other interference, this Site like any other website is not free from such risks. GK8 disclaims all liability on account of any loss or damage that any user may suffer or incur on account of any alteration or manipulation of any data or information accessed or downloaded from this Site.9.5 Whilst GK8 endeavors to take every reasonable precaution to ensure accuracy, security and confidentiality of information available through / on the Site, GK8 cannot be held responsible for any consequence of any action(s) carried out by any authorized or unauthorized user.
10.1 Disclosure of your Personal Data within GK8Where we transfer your Personal Data to another country outside the European Economic Area (“EEA”) or the UK, we will ensure that it is protected and transferred in a manner consistent with legal and regulatory requirements. Again, there may be circumstances where you object to, or ask us to restrict, our processing of your Personal Data but we are legally entitled to refuse that request;(g) the right not to be subject to a decision when it is based on automatic processing, including profiling, if it produces a legal effect or similarly significantly affects you, unless such profiling is necessary for the entering into, or the performance of, a contract between you and us;(h) the right to withdraw your consent where we rely on it as our legal basis for processing your personal data. 11.1 If you are a California resident, you may have additional rights pursuant to the California Consumer Privacy Act of 2018 (“CCPA), as amended by the California Privacy Rights Act. However, it is important to note that the CCPA does not apply to personal information to collected pursuant to other privacy laws such as the Gramm-Leach-Bliley Act (“GLBA”) or the California Financial Information Privacy Act (“FIPA”). If you are a client, it is likely that most of the data GK8 collects about you will be subject to those laws rather than the CCPA.11.2 For personal information that is subject to the CCPA, California residents may have the following rights, subject to certain exceptions and limitations:(a) the right to request access to your personal information and know the following:(i) categories of personal information, the categories of sources from which the personal information is collected;(ii) the business or commercial purpose for collecting, selling, or sharing personal information (GK8 does not sell personal information);(iii) the categories of third parties to whom GK8 discloses personal information; and(iv) the specific pieces of personal information the business has collected about you;(b) the right to request that GK8 delete personal information that we collect and retain about you; and(c) the right to request that we correct and personal information that is inaccurate and incomplete.GK8 does not “sell,” as that term is defined in the CCPA, any personal information to any third parties, including the personal information of any minors under the age of 16. Our Services are only eligible to individuals who are the greater of eighteen (18) years of age or the age of legal majority in their jurisdiction (“Applicable Age“). We do not knowingly collect or solicit Personal Data from anyone under the Applicable Age. By accessing, using or interacting with our Services, you certify to us that you are not under the Applicable Age. In the event that we learn that we have collected Personal Data from an individual under the Applicable Age without verification of parental consent, we will delete that information upon discovery.
